1. Information on how to enter and other promotional materials setting out the promotion details form part of the terms and conditions which apply to this promotion. Entering into this promotion shall be deemed to be an acknowledgment and acceptance of the Terms and Conditions set out below.
2. Entry is open to all Australian residents. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter.
3. The promotion commences on 9.00 am AEST on October 9, 2009 and concludes 11.59pm AEST on April 9, 2010 (“Promotional Period”). The winning entries will be selected at 12 noon April 23, 2010 at Caroma Industries Limited, 4 Ray Road, Epping NSW 2121.
4. To be eligible to enter, individuals must, during the Promotional Period:
(b) follow the prompts to the competition entry page;
(c) input the requested details;
(d) upload a photo of their new bathroom (ie. the bathroom owned by the entrant);
(e) optional: in twenty words or less tell us what they like about their new bathroom. Photo images must be in the format and size specified on the said promotional website.
5. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity and place of residence) and to disqualify any
entrant who submits an entry that is not in accordance with these Terms and Conditions, or who tampers with the entry process, or who submits an entry that the Promoter,
in its sole discretion, deems to be offensive, inappropriate, defamatory or otherwise not in keeping with the spirit of the Promotion. Errors and omissions will be accepted at the
Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
6. When you submit any materials via the Promotion including comments, recordings and images (“Content”), you, unless the Promoter advises otherwise, license and grant the Promoter, its affiliates and sub-licensees a non- exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish, communicate to the public and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability.
7. Limitations on entry: (a) only one (1) entry per person..
8. This is a game of skill and chance plays no part in determining the winners. Entries will be assessed by the judges appointed by the Promoter. The judges will assess each entry based on creativity and originality. The best 5 entries, as determined by the judges, will each win a cheque to the value of $2,000.00. The maximum prize available to an entrant is $2,000.00. The total prize pool is $10,000.00.
10. In the event of any prize being unclaimed or deemed ineligible, the judges, in their absolute discretion, will select the ‘new’ winner(s) of the prize from other eligible entries.
11. The winners will be notified by mail and/or phone and by publishing the results in the The Australian newspaper on April 27, 2010.
12. It is a condition of taking the prize that the winner provides consent to the Promoter to use the winner’s name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an indefinite period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
13. The Promoter’s decision is final and no correspondence will be entered into.
14. Incomplete, indecipherable, or illegible entries/votes will be deemed invalid. Any incorrect details submitted may render the corresponding entry invalid.
15. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the
Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; and/or (b) to modify, suspend,
terminate or cancel the promotion, as appropriate.
16. Any cost associated with accessing the promotional website and making a valid entry is the entrant’s responsibility and is dependent on the internet service provider used by the entrant. All entries become the property of the Promoter.
